These Terms of Service apply to your use of the Got It Rex website and to products purchased from us through our online store.

In these Terms, “Got It Rex”, “we”, “us” and “our” refer to Auto Interest Pty Ltd, trading as Got It Rex.

By accessing our website or placing an order with us, you agree to these Terms together with our Privacy Policy, Refund & Returns Policy and any other policies referred to on our website.

1. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any right, guarantee, warranty or remedy available to you under the Australian Consumer Law or any other applicable law where that right cannot lawfully be excluded.

Where there is any inconsistency between these Terms and a right that cannot lawfully be excluded, the applicable law will prevail.

2. Website and Account Information

You must provide accurate and current information when placing an order or creating an account.

You are responsible for maintaining the security of your account credentials and for activity carried out through your account.

You must not use the website for unlawful, fraudulent or malicious purposes or interfere with the operation or security of the website.

We may restrict or suspend access to the website where we reasonably believe misuse, unlawful activity, fraud, security risk or a material breach of these Terms has occurred.

3. Products, Descriptions and Vehicle Compatibility

We take reasonable care to provide accurate product descriptions, photographs, specifications and compatibility information.

Automotive compatibility can depend on factors including:

  • vehicle model and variant;

  • model year and build date;

  • engine and transmission specification;

  • drivetrain configuration;

  • factory options;

  • previous repairs;

  • aftermarket modifications; and

  • other vehicle-specific differences.

Customers are responsible for reviewing product information and confirming suitability before ordering where compatibility is reasonably capable of being determined by the customer.

Where you tell us the particular purpose for which a product is required and reasonably rely on our advice or recommendation, your rights under the Australian Consumer Law may apply to that recommendation.

Nothing in this section limits your rights where goods are faulty, unsafe, do not match their description, are not fit for a disclosed purpose, or otherwise fail to comply with an applicable consumer guarantee.

4. Orders

Submitting an order constitutes an offer to purchase the products shown in your order.

An order is accepted when we confirm acceptance or otherwise commence fulfilment of the order.

We may decline or cancel an order before fulfilment where reasonably necessary, including where:

  • a product is unavailable;

  • an obvious pricing or product-description error has occurred;

  • payment cannot be processed;

  • fraud or misuse is reasonably suspected;

  • we cannot lawfully supply the product; or

  • circumstances outside our reasonable control prevent fulfilment.

If we cancel an order after payment has been received, any amount properly owing to you will be refunded using the original payment method where practicable.

Please review your order carefully before submitting it. Once an order has entered processing or dispatch, we may not be able to accommodate a cancellation request.

5. Pricing and Payment

Unless otherwise stated, prices displayed on the website are in Australian dollars (AUD) and include GST where applicable.

Prices, promotions and availability may change from time to time.

The applicable price for an order is the price displayed and accepted at checkout, subject to correction of genuine and obvious errors as permitted by law.

Shipping and any other applicable charges will be displayed or calculated during checkout where practicable.

You must provide valid and authorised payment information.

6. Shipping and Delivery

Delivery timeframes displayed on the website are estimates unless expressly stated otherwise.

Delivery may be affected by carrier delays, stock availability, weather, public holidays, customs, remote-area delivery and other matters outside our reasonable control.

We will take reasonable steps to fulfil orders within the timeframe communicated to you.

If we are unable to supply goods you have paid for, or if a delivery problem gives rise to rights under applicable law, we will provide an appropriate remedy.

Please ensure the delivery address supplied at checkout is accurate.

Additional charges resulting from an incorrect address, redirection request or failed delivery may be payable by the customer where permitted by law.

7. Returns, Refunds and Incorrect Purchases

Returns and refunds are governed by our Refund & Returns Policy, which forms part of these Terms.

Our change-of-mind or incorrect-purchase policy is additional to, and does not replace, your rights under the Australian Consumer Law.

Got It Rex is generally not required to provide a refund merely because a customer:

  • changes their mind;

  • no longer wants the product; or

  • orders the incorrect product where the product supplied correctly matches the order and description.

Where offered, change-of-mind or incorrect-purchase returns may be subject to the conditions stated in our Refund & Returns Policy.

8. Installation, Modification and Product Use

Automotive components should be installed and used in accordance with any manufacturer instructions, specifications and warnings.

Some products may require professional installation, specialist tools, vehicle modification, tuning, calibration or additional supporting components.

Customers should ensure installation is carried out by a suitably qualified or experienced person where the nature of the product reasonably requires it.

To the extent permitted by law, Got It Rex is not responsible for loss or damage caused by circumstances such as:

  • incorrect installation;

  • improper use;

  • unauthorised modification;

  • use outside the manufacturer's stated specifications;

  • failure to follow installation or maintenance instructions; or

  • other misuse.

Nothing in this section limits any applicable rights under the Australian Consumer Law.

9. Motorsport, Competition and High-Performance Use

Motorsport, competition, track and high-performance vehicle use may expose components to loads, temperatures, operating conditions and stresses beyond normal road use.

Where a product is expressly sold for motorsport, competition or other specialised use, customers should consider the intended use, manufacturer specifications and any stated limitations before purchasing or using the product.

Damage or failure caused by misuse, incorrect installation, modification, competition use, or operation outside the intended or stated specifications of a product may not be eligible for a refund, replacement, credit or warranty remedy.

However, nothing in this section excludes or limits any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

10. Product Availability and Changes

Products may be changed, replaced, updated or discontinued from time to time.

We may limit quantities or availability where reasonably necessary.

Product manufacturers may also revise designs, specifications, packaging, colours, branding or part numbers.

Where a material substitution is proposed after an order has been placed, we will seek your agreement where required before supplying a materially different product.

11. Website Content and Errors

We aim to keep information on the website accurate and current.

Occasionally the website may contain typographical errors, incorrect pricing, outdated availability, incorrect specifications or other mistakes.

We may correct genuine errors or update website information at any time.

If a material error affects an order you have placed, we will contact you where reasonably practicable and provide an appropriate option, which may include confirming the corrected order or cancelling and refunding the affected item.

12. Intellectual Property

Unless otherwise stated, content created by Got It Rex for the website, including original text, graphics, branding and website materials, is owned by or licensed to Got It Rex.

Manufacturer names, product names, logos, trademarks, photographs, specifications and other third-party material remain the property of their respective owners.

Nothing on this website grants you ownership of any intellectual property.

Website content may be viewed and used for ordinary personal purchasing purposes. It must not be reproduced, republished, commercially exploited or distributed without permission from the relevant rights holder, except where permitted by law.

13. Third-Party Services and Links

Our website may contain links to, or integrations with, third-party services including payment providers, delivery providers, social platforms and other websites.

Third-party services operate under their own terms and privacy policies.

Got It Rex is powered by Shopify, which provides the ecommerce platform used to operate our online store.

Sales made through this website are transactions between you and Got It Rex.

Shopify is a technology provider and is not the seller of the products purchased from Got It Rex.

Your use of Shopify-related functionality may also be subject to applicable Shopify terms and privacy practices.

15. Privacy

Personal information collected through the website is handled in accordance with our Privacy Policy and applicable privacy laws.

Shopify and other service providers may process information on our behalf in order to provide ecommerce, payment, analytics, advertising, communications, fraud-prevention and related services.

If you submit a product review, photograph, comment, suggestion or other content to Got It Rex, you confirm that you have the right to provide that material.

You grant Got It Rex a non-exclusive, worldwide and royalty-free licence to use, reproduce and display that material for reasonable business and promotional purposes.

We may remove content that is unlawful, misleading, abusive, defamatory, infringing, fraudulent, irrelevant or otherwise inappropriate.

We will not knowingly alter or manipulate customer reviews in a way that creates a false or misleading impression.

You must not use the website to:

  • impersonate another person;

Where liability can lawfully be limited, Got It Rex will only be responsible to the extent required by applicable law.

These Terms do not exclude any right to compensation for reasonably foreseeable loss or damage available under the Australian Consumer Law.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, products, technology or legal obligations.

The current version will be published on this website together with its latest update date.

Changes will not retrospectively remove rights that have already arisen under an existing purchase or applicable law.

20. Governing Law

These Terms are governed by the laws of Victoria, Australia.

The parties submit to the courts and tribunals having jurisdiction in Victoria, subject to any rights or jurisdiction that cannot lawfully be excluded.
